1. Introduction & Agreement

Welcome to Pinkkee Craft. These Terms and Conditions govern your use of my website and the web design services provided by me, Gurjeet Singh Walia (“I”, “me”, “my”). By engaging my services, you (“Client”, “you”) agree to be bound by these terms. Please read them carefully. The submission of a project proposal or payment of a deposit constitutes a contractual agreement between you and Pinkkee Craft.

2. Services and Scope of Work

I provide WordPress web design and development services as detailed on my website and in individual project proposals. The specific scope of work, including deliverables, features, and timelines, for each project will be explicitly outlined in a formal Project Proposal. Any work requested by the Client that falls outside this scope will be considered a “Change Request” and may incur additional fees.

Services do not include domain name registration, web hosting, or ongoing maintenance unless explicitly stated in the Project Proposal.

3. Client Responsibilities

To ensure a smooth and timely project, the Client agrees to the following:

  • Content and Materials: You must provide all necessary content (text, images, logos, etc.) required for the project in a timely manner. Delays in providing these materials may result in project delays for which I am not responsible.
  • Copyright: You must have the legal right to use all content you provide. You agree to indemnify and hold me harmless from any claims or suits arising from the use of such materials.
  • Feedback and Revisions: You agree to provide timely feedback and approvals. The project proposal will specify the number of revision rounds included. Additional revisions will be chargeable.
  • Point of Contact: The Client must appoint a single point of contact who is authorized to make decisions on behalf of the Client.

4. Fees and Payment Terms

All prices are quoted in the currency specified in the Project Proposal. My payment schedule is as follows:

  • An initial non-refundable deposit of 50% of the total project cost is required before any work begins.
  • The remaining 50% is due upon completion of the project, prior to the website launch or delivery of final files.

All payments are non-refundable. If a project is terminated by the Client for any reason, the Client agrees to pay for all work completed up to the date of termination.

5. Project Timelines and Delays

I will provide an estimated project timeline in the Project Proposal. These timelines are estimates and can be affected by factors such as delays in client feedback, content provision, or change requests. I am not liable for any delays caused by the Client.

6. Intellectual Property and Copyright

Upon receipt of full and final payment, copyright and ownership of the final website design and code will be transferred to the Client. I retain the right to:

  • Display the completed project in my portfolio, on my website, and in other marketing materials.
  • Retain copyright for any preliminary designs or concepts not chosen by the Client.

Any third-party components, such as premium plugins or stock photos, are subject to their own licenses and are not covered by this transfer of copyright.

7. Website Launch and Post-Launch Support

Once the final payment has been received, I will launch the website on the Client’s chosen hosting provider. I offer a 30-day post-launch support period to address any bugs or technical issues that may arise. This support does not include adding new features, making significant design changes, or providing training beyond what was agreed in the proposal.

8. Limitation of Liability

In no event shall Pinkkee Craft be liable for any lost profits, or any direct, indirect, incidental, special, or consequential damages arising out of or in connection with my services or this agreement. My total liability to you for any claim arising from this agreement will not exceed the total amount paid by you for the services.

I am not responsible for issues related to third-party services, including but not limited to web hosting, domain registrars, or third-party plugins.

9. Termination

This agreement may be terminated by either party with 14 days written notice. If the Client terminates the agreement, no refunds will be provided for payments already made, and the Client must pay for all work completed to date. If I terminate the agreement, I will provide a refund for any work not yet completed.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising from this agreement will be subject to the exclusive jurisdiction of the courts in Punjab, India.

11. Changes to These Terms

I reserve the right to modify these terms at any time. Any changes will be posted on this page, and the “Last Updated” date will be revised. Your continued use of my services after any changes constitutes your acceptance of the new terms.
